The Labor Incident Act (the “Act”) was promulgated on December 5, 2018 and went into effect on January 1, 2020. After the 2019 flight attendants strike ended, Taoyuan Flight Attendants Union filed an action against Eva Air with the Taoyuan District Court on the first day the Act went into effect. The Flight Attendants Union alleged EVA Air’s omission to act and conducted differential treatment against strike-participating union members. One of Formosan Brothers’ partners, Ms. Jessie Lee, together with Mr. Rei-Yang Chu, were appointed as the mediators by the chief judge of the Taoyuan District Court. With thier professional knowledge and experience with handling of aviation labor affairs, they assist the parties in resolving their differences. After three labor mediation sessions, under the premises of protecting the best interests of both labor and management while promoting cooperation, the mediation was successful, and a consensus was reached on the basis of neutrality and impartiality. Such a result not only settled the long-term disputes between Eva Air and the Flight Attendants Union arising from the strike held in June 2019, but it was also the first successful settled dispute of the Taoyuan District Court since the implementation of the Labor Incidents Act. This sets a new milestone in the field of labor-management relationships.
