The Addition of Article 24-1 to the “Sports Industry Development Act”: Ticket Sellers Should Refrain from Improper Purchasing Tickets or Selling “Scalper Tickets”

On January 3 of this year (2024), Article 24-1 of the “Sports IndustryDevelopment Act” was promulgate. In reference to the legislative spirit of Article10-1 of the “Development of the Cultural and Creative Industries Act,” itstipulates that, for "selling publicly available tickets for sportscompetitions or activities," if the seller sells the tickets for an amountexceeding the price shown on the tickets or sells tickets do not have theirprice shown on the ticket for an amount exceeding their fixed price, the sellerwill be subject to a fine of ten to fifty times the price shown on the ticketsor the fixed price for tickets have already sold, and if fraudulent informationis provided via computer or other equipment or other irregularities occur whenpurchasing tickets or obtaining claim tickets to sports competitions oractivities, the penalty shall be a maximum three years’ imprisonment.

Article 24-1 of the SportsIndustry Development Act was added to ensure the normal distribution of ticketsfor sports competitions or activities and the sound development of the sportsindustry. Therefore, ticket traders should refrain from selling "sportscompetitions or activities tickets for public sale" at a price thatexceeds the price shown on the tickets, or selling tickets do not have theirprice shown on the ticket for an amount exceeding their fixed price, or "illegitimatelybuying large quantities of tickets by means of computers or other relatedequipment." However, when the Legislative Yuan passed this amendment, italso passed an accompanying resolution requesting the competent authoritiesthat, in the course of future law enforcement, not to penalize those who reselltickets for sports competitions or activities previously obtained from eventholders and charge additional fees for the actual expenditure of reasonable andnecessary fees, such as handling fees and postage. Such circumstances do not pertainto the aforesaid situation of "selling at higher prices" and will notbe penalized.
