Ms. Yi-Hsuan Wang andMr. Shi-Wei Chao, a Ph.D. candidate of UC Berkeley, co-presented “TheIntersection of Standard-essential Patent Injunctions and the Obligation toNegotiate in Good Faith” Basedon the analysis of practical insights on injunction issues instandard-essential patent (SEP) cases in the US, the EU and China, thepresentation focused on the degree of connection between the standards ofdetermination for the issuance of injunctions and the obligation to negotiatein good faith, and further explored how good-faith negotiation and injunctionsare connected and why negotiation obligation is especially necessary for SEPs,and whether the obligation to negotiate in good faith is sufficiently concreteand detailed.
